Pedestrian, motorist seriously injured in Fayetteville car crash

A minor fender-bender was not the cause of several injuries that were reported after an accident in Fayetteville last week. According to police, a 27-year-old man was driving recklessly on the road before he caused a serious accident and struck several objects including a pedestrian and another vehicle.

The victims of the accident may be feeling fortunate right now to have survived, but their recovery will not be quick. Two of the victims suffered serious injuries including broken bones. Depending on the severity of their injuries, they may need to undergo costly surgeries and take several weeks off of work while they recover. This could certainly create a very stressful situation for these folks and their families if they do not have access to extra cash in order to pay for their medical expenses and hospital bills.

Hospitals disclosing medical mistakes to reduce malpractice suits

Medical malpractice might not be as uncommon as one might think it is in Fayetteville. Mistakes can easily be made when doctors and nurses are negligent, or when hospitals fail to implement procedures to properly address emergency medical situations.

Sadly, these medical errors can result in serious or fatal injuries. And sometimes, patients are not even informed about a complication that occurred during surgery because a nurse or doctor had made a medical mistake. Medical professionals might attempt to hide these errors for fear of being sued if they are honest with patients.

To increase patient safety and to focus on the importance of being open and honest with patients, seven hospitals in Massachusetts are testing a pilot project that some believe could cut down on the costs of medical malpractice lawsuits for medical professionals while also making sure that victims receive fair settlements for their injuries as well as an apology.

Study: Turn signal neglect more dangerous than distracted driving

Within the last couple of years, traffic safety advocates have focused a great deal of attention on ways to reduce texting while driving in North Carolina and throughout the entire country. Many studies have shown that distracted driving can actually be just as dangerous as driving under the influence of alcohol and results in far too many car accidents. Such accidents claim thousands of lives each year. In fact, the U.S. Department of Transportation reports that distracted driving contributes to about 950,000 minor and serious car accidents per year.

A new study, however, conducted by the Society of Automotive Engineers, surprisingly found that turn signal neglect actually results in twice as many crashes compared to distracted driving crashes. Based on the organization's research, drivers don't properly use their turn signals 750 billion times a year on U.S. roadways. Failing to use a turn signal contributes to as many as 2 million motor vehicle accidents per year, the study states.

Fayetteville hospital settles mother's wrongful death lawsuit

Losing a loved one is certainly a painful and devastating experience for any Fayetteville family. But what if you found out that the death of your loved one could have been prevented? How would you feel waking up each morning knowing that your son, daughter, wife, husband, mother, father or sibling would still be alive had someone else made appropriate choices that would have prevented your loved one from sustaining fatal injuries after an accident, a medical mistake or an assault on one's property?

After her son's wrongful death in April 2011, one mother finally received some justice earlier this month. According to reports, the Fayetteville hospital where her son died agreed to settle the woman's wrongful death lawsuit. Although the settlement, which remains confidential, is certainly a victory for the woman, she is still hoping that criminal charges will be filed against the individuals she believes were partly responsible for killing her son.

Weekend auto accidents in Fayetteville result in many injuries

The weekend is finally here, but don't let your excitement over the end of the work week get in your way of paying attention to the road while you are driving in Fayetteville. Last weekend, emergency responders had to rescue several motorists who were trapped in their vehicles after they were involved in auto accidents.

Although no one suffered fatal injuries in the crashes, one can only imagine how bad the damage must have been -- not to mention how frightening the situation must have been as well -- if the victims were not capable of escaping the vehicles on their own.

Laws to prevent drowsy driving still on hold in trucking industry

Earlier this year on our Fayetteville, North Carolina, personal injury law blog, we discussed one woman's fight to raise awareness of the need for stricter state and federal laws governing the trucking industry.

In particular, the woman and other safety advocates called for laws that would help to reduce the number of truck drivers who hit the roads while drowsy. The North Carolina woman experienced the consequences of driver fatigue first-hand. Her husband was killed in a truck accident last year after a truck driver fell asleep while on the road and crashed into the car the woman's husband was driving.

Last month, it appeared that the Federal Motor Carrier Safety Administration was close to proposing new laws that would have required overweight truck drivers in the U.S. to be tested for sleep apnea. Sleep apnea is likely to lead to chronic fatigue because people with the condition do not rest well. That lack of energy could lead to performance and safety problems on the road. However, the FMCSA later reported that it has not yet made any decisions to enforce the proposed guidelines.

North Carolina gas pedal crashes common amongst teens and elderly

There is no doubt that negligent or distracted drivers on our Fayetteville roads have a higher risk of being injured or injuring others in a motor vehicle accident. One major distraction is the use of electronics and other hand-held devices such as cell phones.

However, another common error drivers seem to make simply as a result of not paying attention to what they are doing is accidentally hitting the gas pedal instead of the brake. It was reported in a recent study that elderly drivers and those under the age of 20 are more likely to cause accidents due to pressing the wrong pedal.

The severity of such a mistake came to light after an 86-year-old driver accidentally accelerated his car in 2003. He panicked and ran through a market, killing 10 people and injuring 63 others.

Cancer misdiagnosis: North Carolina woman cautions other patients

When Fayetteville residents experience abnormal symptoms that could indicate that there is something seriously wrong with their health, they turn to their physicians and other medical experts for help. After all, it is the duty of doctors to carefully analyze each patient's unusual symptoms and to perform any necessary tests in order to rule out a serious disorder or to make a proper diagnosis.

A misdiagnosis could prevent a patient from being able to take advantage of medical treatment in order to stop one's illness or disease from causing further health problems. That is what happened to one North Carolina woman who is now dying from breast cancer. Her advice to other patients: Understand that medical professionals do make mistakes, especially when doctors fail to communicate effectively with each other. This lack of communication between specialists and physicians can result in a failure to diagnose cancer.

Ruling upheld in North Carolina teen's wrongful death from Taser

The Taser is a very common tool used by law enforcement. The tool administers an electric shock which helps subdue suspects who resist arrests or threaten officers during an arrest. However, the parents of a North Carolina teen have claimed that the use of a Taser by law enforcement also led to the wrongful death of their son.

Their son, who was only 17, died in 2008 after he was shot with a Taser by police. According to reports, the boy was terminated from his job and he became upset. Police were called to the scene where the teen was fired to handle the situation. But in doing so, an officer used a Taser to subdue the teen. The Taser was shot toward the teen's chest, where the darts were embedded. The officer then held down the trigger and unleashed an electrical current through the teen's body. Thirty-seven seconds later, the teen dropped to the ground. The officer administered another short jolt while he was on the ground.

Injured woman sues North Carolina trucking firm after crash

When a Fayetteville motorist, pedestrian or bicyclist is injured in a truck accident, he or she may be entitled to compensation for any injuries resulting from the accident.

However, truck companies oftentimes attempt to avoid being held liable for truck accident victims' injuries, and insurance companies will work hard to protect trucking firms or commercial vehicle companies from being held accountable for any negligence. Additionally, if a truck driver does not have proper insurance coverage, it may be even more difficult for an accident victim to receive the compensation he or she may need after suffering serious injuries in a crash.

One woman who was injured in a crash caused by an uninsured driver for a North Carolina-based trucking firm is now taking legal action after the driver and company failed to accept responsibility for the crash. She is requesting damages to cover lost wages, mental anguish and physical pain resulting from the crash. One can only imagine how frustrated she must be that she has yet to receive compensation to cover expenses resulting from her injuries, but also that the driver who allegedly caused the crash has yet to take responsibility for the incident.
